These Terms of Service explain the conditions under which you may use the cloud storage services, client software, and websites (together, the "Services"). By creating an account or using the Services, you agree to be bound by these Terms and by the accompanying Privacy Policy.
1. Service Provider and Scope
The Services are provided by Tenbox Inc. ("we," "us," "our"). These Terms govern your access to and use of:
- The cloud storage platform and related features.
- Client software (such as desktop or mobile apps).
- Associated websites and web interfaces.
2. User Data and Permissions
When you use the Services, you may upload or create files, content, messages, contacts, and other materials ("User Data"). You retain ownership of your User Data. These Terms do not grant Tenbox ownership rights over your content.
To operate and improve the Services, you grant Tenbox and its affiliates a limited license to host, store, process, back up, and scan User Data. This includes activities such as:
- Maintaining backups and enabling sync across devices.
- Processing data for search, organization, and file management.
- Detecting and preventing abuse, malware, or policy violations.
This license is strictly limited to what is necessary to provide and protect the Services.
3. Acceptable Use Policy
You agree not to misuse the Services or assist others in doing so. Prohibited activities include, but are not limited to:
- Probing, scanning, or testing system or network vulnerabilities.
- Circumventing security or authentication mechanisms.
- Accessing or tampering with non‑public areas or shared areas you are not invited to.
- Overloading, attacking, or disrupting the Services.
- Sending deceptive or spoofed communications.
- Abusing referral or promotion programs to obtain undeserved benefits.
- Circumventing storage limits or technical restrictions.
- Publishing or sharing illegal, pornographic, extremely violent, or terrorist content.
- Advocating bigotry or hatred based on protected characteristics.
- Violating privacy or intellectual property rights.
4. User Responsibilities
You must:
- Use the Services only as permitted by applicable law.
- Be at least the minimum age required in your jurisdiction.
- Keep your account credentials secure and up to date.
- Ensure that you have the necessary rights to upload, share, or otherwise process any content.
5. Software License
If you download client software, you receive a limited, non‑exclusive, non‑transferable, revocable license to use that software solely for accessing the Services. You may not reverse engineer or decompile the software except where explicitly allowed by applicable law.
6. Subscription Storage Upgrades & Paid Features
The Services offer free storage and optional paid upgrades. Key points:
- Paid features and storage are available on subscription or other billing cycles.
- Subscriptions typically renew automatically unless you cancel before the end of the term.
- Fees are due at the time of purchase and are not refunded once billed, except as required by law.
- Failure to pay may result in suspension of paid features.
7. Termination and Service Changes
You may stop using the Services at any time. The provider may suspend or terminate your access if you materially breach these Terms, your use creates a real risk of harm, or legal obligations require action.
8. Disclaimers and Limitation of Liability
The Services are provided "as is," without warranties beyond those required by applicable law. The provider and its affiliates are not liable for indirect, incidental, special, punitive, or consequential damages.
9. Dispute Resolution and Governing Law
Before bringing a formal claim, you agree to attempt informal resolution via the designated support email. If unresolved, disputes will be brought before the courts specified in the Terms.
10. Modifications to the Terms
The provider may update these Terms to reflect changes in law, regulatory requirements, or the Services themselves. Material changes will be communicated in advance, and updates will take effect no sooner than 30 days after notice.
